The research study addresses one of the areas concerned with the social and legal protection of children, namely the support of foster families. The concept of the accompaniment of foster families was introduced by the Act on the Social and Legal Protection of Children in 2013 and, since this time, it has constituted an indispensable part of the provision of support for foster families to provide the care for entrusted children. The concept of accompaniment covers the rights and obligations of foster parents, the accompanying organisation, which is selected by the foster parents, and the social and legal protection body, which ensures the supervising position of the state. Such activities are financed in the form of a state allowance for the performance of foster care, the recipient of which is the accompanying organisation, and which is directly linked to a contract concluded on the provision of foster care with the foster parents. Given that, up to 2013, all support for foster families was exclusively connected in particular with the social and legal protection of children, accompaniment represents a relatively new concept that has raised a number of issues that need to be resolved. In particular, they concern issues surrounding the rights and obligations of the various participants, whether they are sufficient to enable the fulfilment of the role of the foster family in the care for entrusted children, issues concerning financing, i.e. whether it is sufficient to cover all the activities necessary in terms of the fulfilment of the various rights and obligations, and whether state financing is provided in accordance with legal norms and children entrusted to them.
The research study provides information on the various activities that are involved in accompaniment, the needs of foster families and the procedure surrounding the claiming of the state allowance for the provision of foster care performance. Further, it identifies the various current deficiencies in the system and suggests possible solutions.
